Increase to Compensation Awards
Further to our previous ‘NEWSFLASH’ setting out the risk to employers in discrimination claims and the level of compensation available to employees, we would like to draw your attention to the increase in the bands of awards for injury to feelings.
An ‘injury to feelings’ award is available to employees who have suffered discrimination or unlawful detriment, but not in claims for unfair dismissal. We set out below the potential compensation levels available.
In respect of claims presented on or after 6 April 2021, the compensation bands shall be as follows:
- Lower band of £900 to £9,100 (less serious cases)
- Middle band of £9,100 to £27,400 (cases that do not merit an
- Upper band of £27,400 to £45,600 (the most serious cases)
The most exception cases are capable of exceeding £45,600, with no upper limit.
