Boundary Disputes – Love thy neighbour
Where is the boundary and whom does it belong to?
This is a question that many practice owners often have in relation to their dental practice or home but are unaware who or where to seek assistance.
The first point of call would be to have a look at any title documents that you may have. If you do not have the titles you are able to access these via Land Registry. If there are no documents stipulating where the boundary is then your best course of action would be to have an informal chat with your neighbour.
If you can reach an agreement with your neighbour you can create a boundary agreement which will record the following:
- The boundary between 2 properties; and
- Who is responsible for maintaining a hedge, wall, tree or fence between 2 properties.
If an agreement cannot be reached then you may need to seek legal advice. It could be that instructing an expert can assist in determining where the boundary lays. However, the neighbours may not agree on what the expert’s opinion. If a settlement cannot be reached then you may have to seek a determination from Courts or Tribunal. However, we would strongly advise against this as the costs in doing so could escalate and we would strongly advise to seek early resolution.
